Nevada Gaming Control Board and CFTC preemption
The NGCB's historical posture
The Nevada Gaming Control Board has jurisdiction over almost anything that involves predicting outcomes and risking money in Nevada. It is the regulatory model that other states' gaming commissions are modeled after: and it has historically been the most aggressive in asserting jurisdiction over novel wagering products. The NGCB successfully regulated daily fantasy sports, challenged sports betting intermediaries, and scrutinized prediction market activities in the 2019–2021 period when Kalshi was seeking CFTC approval.
However, the October 2024 federal court injunction, which blocked Nevada's attempt to restrict Kalshi's sports event contracts: established that CFTC preemption applies to CFTC-regulated designated contract markets (DCMs). Since that ruling, the NGCB has not taken new enforcement action against CFTC-regulated prediction market platforms. The caution rating reflects Nevada's historically aggressive regulatory posture and the casino industry's interest in limiting competition, not current active enforcement.
The casino industry dynamic
Nevada's casino industry has significant political influence in the state legislature and with the NGCB. Prediction markets that cover sports outcomes are viewed as competitive products to Nevada's licensed sportsbooks: MGM Grand, Caesars, Wynn, and others. The industry has lobbied against federal prediction market expansion in congressional hearings. Whether this translates into renewed NGCB enforcement action against CFTC-regulated platforms remains a risk to monitor.
