Prediction Markets
in New Hampshire

New Hampshire is fully open for prediction markets with a tax-favorable profile: the state does not tax earned income or capital gains at the state level, so event contract profits are subject to federal taxes only. Sports betting launched in December 2019: New Hampshire was one of the earliest Northeast states to go live after PASPA. All major prediction market platforms are available with no enforcement actions.

No income tax + early sports betting adopter

New Hampshire does not levy state income tax on wages, salaries, or investment income (interest income and dividends over $2,400 were taxed at 5% but that tax was phased out and eliminated in 2025). Prediction market profits (classified federally as ordinary income) are therefore subject only to federal rates in New Hampshire.

New Hampshire launched mobile sports betting in December 2019 with DraftKings as the exclusive operator for the first phase. The early launch gave NH residents access to regulated sports wagering while most neighboring New England states were still debating legislation. FanDuel and other operators have since been licensed. CFTC-regulated prediction markets operate alongside NH's sportsbook framework under entirely separate federal jurisdiction.

NH vs Massachusetts: NH residents can use Kalshi, Polymarket QCEX, and all sports betting platforms. Massachusetts residents have sports betting but Polymarket QCEX is restricted due to AG enforcement. NH's open status and zero income tax make it one of the best Northeast states for prediction market trading.
